Welcome to Qorden AI LTD. These terms and conditions apply to your use of our website and our artificial intelligence-powered speech analytics software, which is made available to you on a software-as-a-service basis. By using our Site or Software, you agree to be bound by this Agreement. If you do not agree to this Agreement, you should not use our Site or Software.

Use of Service

Our software services are provided on a subscription basis. By subscribing to our services, you agree to pay the fees associated with your chosen subscription plan. The use of our software services is subject to the terms and conditions set forth in this Agreement.

Subject to the terms and conditions of this Agreement, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Software solely for your own internal business purposes. You may not sublicense, sell, or distribute our Software to any third party.

Subscription Plans

We offer a variety of subscription plans to meet the needs of our customers. The specific features and pricing of each plan are contractually agreed upon before transaction. We reserve the right to change the features and pricing of our plans as per our contractual agreement with the client.

Payment and Refunds

All subscription fees are due at the beginning of each billing cycle. Failure to pay the fees associated with your chosen subscription plan may result in suspension or termination of your access to our software services. We do not offer refunds for any fees paid in connection with our software services.

Proprietary Rights

Our software services, including any updates, enhancements, or modifications thereto, and all intellectual property rights therein, are and shall remain the exclusive property of Qorden AI LTD. You acknowledge that the Company retains all right, title, and interest in and to the software services and any related documentation, and that you do not acquire any ownership rights in the software services or related documentation. Our website and Software, including but not limited to all text, graphics, logos, images, and software code, are the property of Qorden AI LTD and are protected by United Arab Emirates and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of our Site or Software without our prior written consent.

User Data

Our Software analyzes and processes data provided by you to provide you with insights and analytics related to your business operations. You retain all right, title, and interest in and to your User Data. By using our Software, you grant us a non-exclusive, worldwide, royalty-free, and sublicensable license to use, copy, modify, distribute, and display your User Data solely for the purpose of providing you with our Software.

Disclaimer of Warranties

The company provides no warranties, whether express or implied, including merchantability or fitness for a specific purpose. The software services are provided "as is," without any warranty.

Limitation of Liability

In no event shall the company be liable for any indirect, incidental, special, punitive, or consequential damages, or damages for loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to or use of our software services.

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, fees of any kind (including reasonable attorneys' fees and legal costs), arising from or relating to your use of our software services, or any violation of these Terms.

Termination

Either party may terminate this Agreement upon written notice to the other party. Upon termination of this Agreement, your right to access and use our software services shall immediately terminate.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

Amendments

The Company reserves the right to modify these Terms and Conditions at any time without prior notice. Your continued use of our software services after any such modifications shall constitute your acceptance of the modified Terms.

Credit and Debit Card

All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties

Method of Payment, Card Types accepted and Currency

We accept payments online using Visa and MasterCard credit/debit card in AED (or any other agreed currency)

Delivery/Shipping/Services Policy

Qorden AI LTD will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE

CANCELLATION OF SERVICES AND REFUND POLICY

CANCELLATION BY YOU

Subscription Cancellation: You may cancel your Subscription at any time, but the cancellation will be effective at the end of the current Subscription period. No refunds are provided for the remaining subscription period.

CANCELLATION BY US

We may suspend or terminate your use of the Services for fraud or breach of any obligations under these Terms, including unauthorized copying or downloading of content. Termination or suspension may be immediate and without notice.
